Denver man to challenge pot arrest after legalization ordinance in effect

When Denver voters passed I-100, the SAFER initiative making possession of up to an ounce of marijuana legal for persons 21 or older, Denver officials vowed to ignore the will of the voters and continue to prosecute people under the state marijuana law. They have lived up to their word, filing state charges against at least 12 adults for simple marijuana possession since then the ordinance went into effect on November 16.

The people spoke, but law enforcement didn't listen. On Nov. 17, a day after Denver's Alcohol/Marijuana Equalization Initiative 100 went into effect—establishing a city ordinance that made the possession of less than one ounce of pot legal for people over the age of 21—Denver police made their first post I-100 pot bust under state law.

Denver District Attorney Mitch Morrissey did his civic duty last month, notifying citizens that their November 1 passage of I-100 -- which changed city ordinances to legalize the possession of an ounce or less of marijuana -- means absolutely nothing, since the DA's office prosecutes 90 percent of cannabis cases under state law, anyway, and state law trumps city law, and blah, blah, blah, and "a class 2 petty offense is punishable by a fine," etc, etc. Translation: Screw you, hippies!
